Adair BD. of Elections meets in Executive Session, votes to adjourn

Appeal filed today; surety bond of $25,000 posted with Adair Circuit Clerk.

The Adair County Board of Elections met today at 3pmCT, went into Executive Session with all four members present, and returned within a few minutes and took a vote which was 4-0, to adjourn.

No additional action was taken at the meeting.

The notice of the appeal was filed today in Adair Circuit Court, notifying the plaintiffs, Ben Arnold, Ruth Smith (Hadley) and William Burton of an appeal to the Kentucky Court of Appeals, has been filed.

The Adair County Board of Elections is represented by Attorney Howard K. Stockton, Edmonton, KY, and Adair County Attorney Jennifer Hutchison Loy. A surety bond, in the amount of $25,000 has been posted in Adair County Circuit Court in the amount of $25,000 for the Adair Board of Elections, as principal, and Joyce Rodgers, as surety, and is time-stamped April 27, 2015, with the signatures of Ben Loy and Billy Curry as principals and Joyce C. Rodgers as surety.

Our Pellyton neighbor, Jay Rose, has accumulated a large store of knowledge regarding birds, animals and plants. We have come to know that when he stops by we will learn more about the flora and fauna of our adopted state. If we encounter an unfamiliar tree or wildflower, Jay will be able to supply identification.

Jay pulled into the driveway of the lower farmhouse as I was crossing the lawn, trowel in hand, at about noon. As I approached the open window of his truck he inquired, "Would you like a turkey dinner?"

Amy Pike: Many unanswered questions on decision by Election Board

Question of how much it will cost to appeal, who pays is raised. 'The initial $4,000 may not sound like an astounding amount but when you add the 'additional fees' it could become an astronomical amount that the taxpayers are liable for. Could this amount be $4,000, $40,000, or $400,000 once everything is completed and the court proceedings are finished?,' she writes, and adds: "It is easy to make a decision when it is not your personal money that is being spent to pay the charges.

Personal commentary

As many, including myself, have stated there are many unanswered questions about the decision made by the Election Board. Mr. Halsey made some excellent points in his commentary.

It is my understanding that both Sheriff Moss and Clerk Greer declined to vote because of their candidacy in the November election. Personally, I do not see as to how that is an adequate reason considering that none of the county races were ever in dispute. To my knowledge, everyone was allowed to vote in the county races. The city races were the only ones with discrepancies where people who lived in the city were not allowed city ballots and some who live in the county were.

I hope this will end in a fair resolution, with voting rights and legal, above-board elections re-established I am also wondering about the lack of a way to fill an unexpected vacancy, be it due to recent circumstances, death, resignation or alien abduction. ACPC Rocket Boosters Fun in the Sun 30 May 2015

The Adair County Primary Center Rocket Boosters - aka PTA - will hold a Family Fun in the Sun fundraising event 10am-2pmCT, Saturday, May 30, 2015, at the Adair County Primary Center, 158 Col. Casey Drive, Columbia, KY.

There will be bouncy houses, a water slide, face painting, balloon animals, and more.

Fun in the Sun offers opportunities for vendors, with booths available to for profits at $35 or $40 with electrical hookups provided; and booths for non-profits free. Contact: 270-570-5218.

Columbia Police Dept. gets evidence after pharmacy breakin

Event occurred at approximately 6:13amCT, Sun 25 Apr 2015, at Certa-Care Pharmacy, 937 Campbellsville Road, Columbia, KY. Perperpetrator(s) had fled, but CPD gathering evidence now being analyzed.

Columbia Police Department responded to an early morning break in at local pharmacy.

On Sunday (04-26-2015) at aproximent, 6:13amCT, CPD officers responded to an alarm at Certa Care pharmacy located at 937 Campbellsville Road. Officers arrived on scene promptly only to find the perpetrator or perpetrators were already gone. A quantity of controlled prescription substances were took.

More questions about this afternoon's Election Board meeting

More questions are being posed, 'off the record,' with a CM Disclaimer: This is new territory. We don't have the answers. We're hoping someone who does will comment.
More questions are being posed about this afternoon's meeting of the Adair County Board of Elections meeting, Off the record, but serious enough to warrant posting, anyway:
  • Is it proper to tell members of the Board of Elections how you feel about their decision to appeal? Or how one plans to vote on future candidacies of elected members - Clerk Lisa Greer and Sherifff Harrison Moss - based on their vote or non vote and the ultimate costs of their decisions? Or County Attorney Jennifer Hutchison-Corbin as counsel to the board? Or are they just doing their jobs?
  • Does money matter where justice is concerned?
  • And, if so, which approach is cheaper on the taxpayers?
  • If the cost of the appeal is substantial, is it fair to hold the Board of Elections responsible? Should they, individually, bear the costs? (Our opinion is that they would not, that it would be paid by the Adair Fiscal Court - CM)
  • If the issue this afternoon is about the appeal approved 2-0 last Wednesday, and if this meeting is about that vote: Why? Was the 2-0 vote not properly taken? On whose say so?
  • If the Board of Elections votes again to appeal, what happens next? Who decides on Current mayor? The County Attorney? The Attorney General of Kentucky? The State Board of Elections? CJE Mike Stephens? the Governor? City Council with the advice of City Attorney Marshall Loy?
Does the decision await a ruling by the Appeals Court? There's a lot at stake here. Comments, more questions welcome. - EW

"If in fact, it was the board of election members egos that were bruised because of the word fraud even though no moral or criminal intents was implied, then they should bear the costs of the appeal since it would seem to be solely on personal grounds." - JON HALSEY

According to Mayor Hardwick's statement:
"The appeal filed by the Adair County Board of Elections was filed because Judge Judy Vance, in her ruling, mentioned fraud by the Board of Elections in two places."
It that is in fact the reason for the appeal it might suggest two unfortunate scenarios. Article continues...

The recent election situation has really posed a lot of interesting discussions. Recently, there were posts on Facebook regarding, in particular, the Mayoral race. Some were positive and several negative. I posted a question to my own Facebook page and received lots of positive feedback. I would like to have some official answers rather than speculation.
