Public Service Commission investigating possible CAUD vacancy Judge Michael Stephens expects ruling that Larry Russell Bryant's appointment to the water board is invalid. If that prevails, the vacancy will be open to all comers, including Mr. Bryant. By Ed Waggener The Kentucky Public Service commission has notified Adair County Judge Executive Mike Stephens that they are investigating a possible vacancy on the Columbia/Adair County Utilities Board of Directors. The notice came in an order issued Monday, 28 Sep 2015. The seat in question is that of Larry Russell Bryant. Mr. Bryant's appointment was made after the Fiscal Court's 90 day option to name a replacement had expired. According to the PSC, an appointment after that time is the prerogative of the PSC itself. At this point, the PSC has laid out regulations which, according to Judge Michael Stephens, mean that the seat is open. It does not necessarily mean that Mr. Bryant might not be named to fill the vacancy. In fact, if, as expected, the PSC finds that the vacancy exists, the PSC will allow all interested persons the opportunity to nominate candidates for the position and "will then determine whether each of these candidates meets the the constitutional and statutory requirements for the office." The Public Service Commission will then make the appointment. Questions remain if the PSC rules that a vacancy exists, including whether or not any of the actions taken by the CAUD board are valid when Mr. Bryant voted.
