Adair Fiscal Court Report, February 12, 2013 Report

In the Tuesday, February 12, 2013 meeting:
  • Court votes to sell old Mack Trucks, lease 2014 models
  • Court accepts $15,214.50 in 2012 excess fees, Sheriff Moss' office
  • Court accepts $162,000 in 2012 excess fees, Court Clerk Blair's office
  • County Treasury has $1,590,743 in reconciled balance, all funds
  • Court approves budget transfers
  • Total Patcher ready to go; new mower purchase recommendation coming in March meeting.
  • Court welcomes Solid Waste Coordinator back. "Roadways a mess," he says. Roadway cleanup starts in March; free tipping will be offered; counties last four big dumps will be cleaned this year
  • Day Lily Road gets second reading; will go on county maintenance
  • Jail report accepted; changes approved in home incarceration program

The Adair County Road Department will have two 2014 Mack Trucks in early March, following votes to sell two 2012 Mack Dump Trucks, and approve the purchase of the two new ones from Worldwide Equipment, along with the approval for Adair County Judge Executive Ann Melton to sign necessary paperwork and to arrange financing through the KACO - The Kentucky Association of Counties.




The action was taken during a relatively brief, 55 minute regular session, with Judge Ann Melton presiding, and all seven magistrates, Harold Burton (1), Daryl Flatt (2), Sammy Baker (3), Perry Reeder (4), Billy Dean Coffey (5), Joe Rogers (6) and Billy Rowe present.

The new trucks will have "Hard Ox" beds, which are lighter but more rugged than the beds on the trucks being sold. According to Jim Dotson, who presented the program to the court, the beds will handle larger materials such as rip rap, and will have an engine with more horsepower. The current models have 405 HP engines; the new ones will have 455 HP.

The new trucks will be $126,816 dollars each, slightly higher than the $117,674 paid for the 2012 models. Mr. Dotson said that he would expect that the new models will bring more at auction with the improved specification. Last year, the court actually sold the trucks for $9,558 more than was paid for them.

Court accepts Sheriff's report and Excess Fees settlement

The court voted to accept Sheriff Harrison Moss' settlement for his offices excess fees in 2012, a total of $15,214.50 and approved his January 2013 report. Both were unanimous votes. The amount was down from $24,939.84 in 2012.

Court accepts Adair County Clerk's excess fees settlement

The court also accepted a check for $162,000, representing 90% of the excess fees from Adair County Clerk Sheila Blair's office. This amount was up $12,000 over the 2012 settlement of $150,000.

County treasury has $1,590,743. reconciled balance at end of January

Adair County Treasurer Barry Corbin reported that the county had a reconciled balance of $1,590.743 on January 31, 2013. That figure is up from $1,392,178.78 a year ago. His report was unanimously approved.

The Court approves possible budget transfers

The court pre-approved budget transfers from the General Fund for the county's three agencies which usually need budget infusions: 1) $10,000 for the Green River Animal Shelter. 2) $60,000 for the Jail Fund. 3) $15,000 to the 911 fund.

The magistrates received copies of the transfers already made for the 7 months of the current Fiscal Year. <
  • $280,000 from the General Fund to the Jail Fund
  • $75,000 from the General Fund to 911
  • $60,500 from the General Fund to Green River Animal Shelter
  • $220,000 from the Road Fund to General
  • $8,000 from Local Government Economic Assistance (LGEA) to General
  • $20,500 from LGEA
A.L. Sinclair gives litter abatement report

For the first time in several months, Adair County Solid Waste Coordinator A.L Sinclair gave the litter abatement report.

He reported that the county will be able to clean up the last four major illegal roadside dumps: One on Jack McQueary Road, another in the Little Cake area, a third on Melson Ridge, and the fourth on Posey Road. Two of the dumps will be removed by Mr. Sinclair's crews. Two will be bid out.

Mr. Sinclair said that the county will have a Spring Free Tipping time again this year. And he reported that roadside cleanups will begin in early March. He said that the situation is worse than it should be. "It's a mess," he said.

Approval of Minutes

The court approved, 6-0, the minutes for January 8, 2013, by a vote of 6-0, with Magistrate Joe Rodgers (District 6), abstaining.

Adair County Road Superintendent reports Total Patcher ready

Adair County Road Superintendent Jobe Darnell reported that the Total Patcher system is now installed and the department is scheduling training of employees to use the equipment.

He reported that sign replacement has been a major problem. Each sign replacement is about $75.00. Third District Magistrate Sammy Blair noted that the vandalism of the signs was not only expensive, but dangerous, too, when law enforcement, firemen, and EMS are delayed in their response because of missing signs, a position CJE Ann Melton emphasized, too. "It may be your family which needs an emergency vehicle," she said. Adding that the county attorney will prosecute. One possibility for catching the perpetrators is to videotape them in action. Another is to find them in possession of the stolen signs.

The county attorney will be researching the possibility of offering rewards in the case of stolen signs. Mr. A.L.Sinclair said that he's also lost "No Dumping" signs to vandalism.

Magistrate Joe Rogers will research cost for a new mowing tractor and present a recommendation at the March court as to whether to bid for the tractor or to buy on a state contract, which would save advertising costs.

Reading of roads

Adair County 911 Addressing and Mapping Coordinator presided over the reading of the roads. Only one action was taken. The court voted unanimously to approve the second reading to bring Day Lily Road, in the the Cane Valley area of District 6, into the county road system.

Jailer Rick Wilson reports jail figures for January, 2013

Adair County Jailer Rick Wilson reported $68,935 in total billings for the Adair County Jail in January, which, minus $19,054.72 for Adair County inmates and and after adding booking fees, medical fees, per diem, home incarceration, and Cumberland County medical fees left $56,713.53 to collect.

Jailer Wilson asked for, and received, permission to have a SCRAM bracelet for the home incarceration program. There will be a $50 connection fee and a $9 per day fee for the bracelet, which will monitor alcohol levels, all paid by the inmates.

The court also approved a recommendation by the Personnel Committee to give back pay of 50 cents an hour additional to two employees, Ricky Bennett and Regina Thompson, for an administrative oversight when a raise was given to other employees, retroactive to the date of the oversight.

He reported that the last four major illegal dumps will be cleaned up this year, and that there will be free tipping in 2013; but he called it a shame now much litter is on the Adair County roadsides for crews to clear this year. "It's a mess," he said. Clean up will start in March.
