FEDS crack down on cell phone use in commercial vehicles LOUISVILLE, KY (2011-01-06) - On January 3, 2012 the Federal Motor Carrier Safety Administration (FMCSA) banned the use of hand-held mobile telephones while operating a commercial vehicle. This ban states under part 392.82(a) of FMCSR that no driver shall use a hand held mobile telephone while driving a CMV. It goes on to state that no motor carrier shall allow or require its drivers to use a hand-held device. There are provisions that allow a driver to communicate in emergency situations with law enforcement, and medical personnel. Drivers may also use hands free devices that only require a one button operation to make a call, answer a call, and to terminate a call. All drivers of commercial vehicles regardless whether they are required to have a CDL or not fall under this new law. Because the use of a hand-held device results in distracted driving and increases the risk of CMV crashes the FMCSA is now requiring CDL drivers that are cited for such violations while operating a CMV be disqualified under this provision. Drivers wishing to use hand held mobile telephones must move from roadway and be in parked position before using a hand-held device. This story was posted on 2012-01-09 16:34:12
