SBDM Elections are opportunity to wield real power in the school Site Based Council Members wield great power in school governance in Kentucky. 'These members are considered elected officials under Kentucky law and the council operates much as an independent board to run the school in question, Supt Alan W. Reed notes in this informational piece and their independence is heavily protect, he writes. 'It is against state law and grounds for immediate removal if a superintendent or board of education member attempts to influence or interfere with the actions of a site-based council or its members.' Dear CM readers: In the 1990 legislative session, the Kentucky legislature passed HB 940, which is best known as the Kentucky Education Reform Act (KERA). Essentially, this piece of legislation forever changed the face of education in Kentucky. One drastic change that came with KERA was in school governance, or who makes hiring decisions in each Kentucky school district, and decides how appropriations from the local board are used within the school. Membership of each council includes: the principal, two elected parents, and three elected teachers at each school. In the event schools reach a certain threshold for minority population, the law requires that a minority member also be elected to the council. Curriculum, hiring decisions are in SBDM domain Under the statutes, most decisions within the school, particularly curriculum and hiring decisions were taken away from boards of education in what is best called "decentralization". Decentralization is a basic premise of SBDM councils, which promote shared leadership among those who are closest to the students. It is against state law and grounds for immediate removal if a superintendent or board of education member attempts to influence or interfere with the actions of a site-based council or its members. I wanted to get this information out to the public since there are still questions about who controls hiring for positions within the school. The law states: From a pool of qualified applicants the principal of the school, after consultation with his/her site-based council, shall submit a recommendation to the superintendent who shall complete the hiring process. It is now election time It is now election time in each of our schools as new SBDM members are selected for the 2015-16 school year. If you have never served on a site-based council I encourage you to run. If you choose not to run for membership, it is vital that you vote since your parent representative will play a key role in all the things I mentioned above. KRS references for Kentucky States governing site-based councils I am including legal references just in case you would like to read the "fine print" contained in the actual Kentucky Statutes governing site-based councils: KRS 160.345, KRS 158.645 and KRS 158.6451.
