Adair Fiscal Court Meeting Report I - September 9, 2014

IN PROGRESS In last night's Adair County Fiscal Court meeting:

A Fight over State Funds and Who Gets Credit: Rep. Carney delivers $385,000 road plan for Roadwork in six of county's seven districts. Judge Melton says that money came from discretionary funds and that she had requested money from that same fund for roads more desperately needed. Magistrates vote unanimously to accept.

Rep. John BAM Carney, Campbellsville, KY presented a $385,000 package of roads with "new" road money for each of six of the county's seven districts. Only District 4, represented by Magistrate Perry Reeder, was left out of Rep. Carney's plan.

A winner in the the District with only 40 miles of roads, represented by Magistrate Billy Rowe, whose district will get 2 miles of roads. Magistrate Rowe, a close ally of Rep. Carney, was defeated in the Republican primary by former Magistrate Terry Hadley.

The magistrates, including Magistrate Reeder, voted 7-0 to accept the road plan presented by Rep. Carney, with Magistrate Daryl Flatt (District 2) moving acceptance, and Magistrate Sammy Baker (3) giving a second saying, who said that he would not be willing to turn down the money, regardless of who got credit for it.



Rep. Carney and Judge Melton let emotions show after initial cordialities were exchanged. Judge Melton said that she had presented a request for money from the same funds Rep. Carney was claiming as "new" money. Judge Melton said that it was discretionary money generally given through the CJE's offices in most counties in the state.

The action rekindled memories of the diversion of the discretionary funds to roads in a subdivision near the country club, by political operatives, instead of going to Judge Melton's requested project, the widening and paving of Cooper Ridge Road. Later, on November 11, 2011, the state send $266,305 from Disaster and Recovery Funds, and that Judge Melton's Cooper Ridge Road was completed.

Judge Melton challenged the media to publish or report the roads and to look at them to see whether the roads she had requested from the same funds were more needed or the ones in the Carney list were. (The lists of roads were not obtained last night, but will be listed as soon as they can be obtained.)

Rep. Carney told the court, after Judge Melton Melton welcomed him for "his first visit to the court," that he did not come to meetings of the court because he thought it was not his business to manage the affairs of the court.

But a few moments later, Rep. Carney called for a vote on his proposal, Judge Melton interrupted, telling Rep. that he was a state representative with no authority to preside over the court.

The vote did move on when Magistrate Flatt called for the question. The roll call vote was 7-0 to accept Rep. Carney's plan, with Magistrates Harold Burton (1), Perry Reeder (4), Billy Dean Coffey (5), Joe Rogers (6) and Billy Rowe (7) affirming.

In another exchange, Rep. Carney alluded to "driveways," and Judge Melton asked him he were implying that the County Road Department had worked on private roads; when Carney refused to elaborate, Judge Melton said told Carney that she had been slandered and asked the County Attorney, Jennifer Hutchison Corbin, if legal action could be taken. Hutchison Corbin told Judge Melton that libel cases for public officials are held to a higher standard than for private citizens, and that she, herself, faces accusations in court on a routine basis.

Adair Fiscal Court approves own rate; accepts taxing units' rates

At the Tuesday, September 9, 2014 regular meeting of Adair Fiscal Court, the court unanimously approved the presentation its own Tax Rates, 7-0 after which the court heard from each of the taxing Districts. Tax rates for this year are as follows:

Justin Bailey presides over Reading of Roads

Justin Bailey, Adair 911 Mapping and Addressing Coordinator conducted the reading of roads.:

Second readings:
  • District 4 (Perry Reeder) - 35mph on Orbie Branham Road
  • District 6 (Joe Rogers) - 25mph on Reedie Tucker Road
First readings:
  • District 1 (Harold Burton) - Homestead Lane (Private Passage)
  • District 5 (Billy Dean Coffey) - 35mph on Old Portland Road
  • District 6 (Joe Rogers) - 25mph on Robinson Ridge Road
Each was introduced the magistrates and were passed unanimously.

County gets $1,236 for separated lots of surplus jail materials
The Adair Fiscal Court opened bids for four lots of materials left over from the recent Perfection Group installation of new heating and air, plumbing, and other items at the Adair Regional Jail. The four lots brought a total of $1,236.


Lot 1 - Air conditioner
Charles Barnes had the winning high bid of $110. Other bids were Tim Bryant, $45; and Sherman Burton, $25.51.

Lot 2 - Various Motors
Charles Barnes had the winning high bid of $110. Other bids were Sherman Burton, $35.51; Harold Burton, $32; and Tim Bryant, $31.00

Lot 3 - Various Metals
Sherman Burton had the winning high bid of $1,151; Other bis were Harold Burton, $662; Tim Bryant, $303; and Charles Barnes, $195. .

Lot 4 - Various Wir3
Sherman Burton had the winning high bid of $65.51; Harold Burton, $41.50; and Tim Bryant $16.00.
Library appointments approved

The Adair County Library Board will have one new member, after the Adair Fiscal Court Unanimously approved the appointment of Cynthia Coomer to a new four year term, ending October 16, 2018. Coomer will replace Nancy Ballou.

The court also approved the re-appointment of Georgina Roy, to another four-year term, ending on October 16, 2016.

With the additions, the Library Board, effective October 16, 2014, will have Beth Grant as President; Mary Knight as Vice President; Georgina Roy, Secretary; Treasurer J.D. Zornes, and Member Cynthia Coomer.

Library Director Lee Ann Jessie, President Beth Grant, and Vice President Mary Knight attended the Fiscal Court meeting.

The Adair County Public Library Board of Trustees meets each second Monday of the month at 12:05pmCT in the library basement, 307 Greensburg Street (Google Map/Directions), Columbia, KY. Meetings are open to the public and governed by the open meetings laws which pertain to all boards. New Skidsteer for Recycling

Only one bid was received for a new Skidsteer loader for the Adair Recycling Center. Wright Implement's bid of $34,996, was unanimously accepted by the court on a motion by Joe Rogers (6) with a second by Sammy Baker (3). The machine was paid for by a grant, which was written by Adair County Solid Waste Coordinator A.L. Sinclair, who was given a round of applause.

Mr. Sinclair quipped that the roadside cleans are getting harder, but it said, "The restaurants are doing well," alluding to the wrappers, boxes, and cups and sacks strewn along the roads after carryouts are consumed.

Sheriff Harrison Moss gives August 2014 activity report

Adair County Sheriff Harrison Moss gave the following activity report:

Court waives one month's rent for Matt Baker

Judge Melton requested the waiver of one month's rent for Matt Baker's Columbia Security, because Baker had been unable to use the offices for one full month because of heat and air conditioning problems. The firm pays $800 per month. The request was unanimously approved.

Court votes $5,000 for dead animal pickup

Jason Grider of the Adair County Soil Conservaton District appeared before the correct to request $5,000 for the dead animal pickup up service. The amount was in the budget and was unanimously approved, 7-0 on a motion by Billy Rowe (7), with a second by Perry Reeder (4).

The amount was already in the budget, County Judge Executive Ann Melton said.

November meeting postponed because of Veterans Day

The November meeting of Fiscal Court, which normally would have be held on November 11, 2014, was postponed until Tuesday, November 18, 2014 because November 11 fell on Veterans Day.

Candidates present for the meeting included Mike Stephens, Melton's opponent for County Judge, was present at the meeting, as was Terry Hadley, candidate for 7th District Magistrate, and Darrel Baker, candidate for Adair County Jailer.
